Privacy policy and information on the processing of your personal data for you who are a NOBH Independent Partner
1. What is a privacy policy?
1.1. In our privacy policy, we explain who is responsible for the personal data processing that takes place in connection with you participating in a collaboration as an independent partner and ordering goods and services from us. We also describe which personal data about you is processed when you provide information to us in various situations, how we process the personal data, why we do it and with what legal support we justify the processing, and tell you which external parties may handle personal data about you for that we should be able to provide the goods and services you ordered. You also receive information about your rights regarding our processing of your personal data and how you can proceed to exercise your rights.
2. Important concepts
2.1. Here are explained some important concepts that may be useful to know in order to understand our privacy policy:
a) "Personal data" means any information relating to an identified or identifiable natural person. An identifiable physical person is a person who can be directly or indirectly identified in particular with reference to, for example, a name, an identification number such as a social security number, a location data, online identifiers such as an IP address or one or more factors that are specific to the physical the person's physical, physiological, genetic, psychological, economic, cultural, or social identity.
b) "Processing" means an action or combination of actions concerning personal data such as collection, registration, organization, structuring, storage, processing or modification, production, reading, use, disclosure by transmission, dissemination or otherwise making available, adjustment or compilation, restriction, erasure, or destruction.
c) "NOBH Independent Partner" means a person or a company that has registered with NOBH as a reseller of NOBH products.
3. Who is responsible for the treatment?
3.1. NOBH (HK) Co. Ltd. is responsible for personal data processing. In this text, NOBH is called "We" and you who are a natural person and are or will become NOBH Independent Partner "You".
3.2. If the partnership agreement is concluded by a company, that company is responsible for its personal data processing and for the legality of the transfer of personal data about, for example, contact persons and users to NOBH. NOBH is only responsible for the personal data processing that takes place at NOBH.
4. General about our personal data processing
4.1. We will only process the personal data about you that is necessary for the purposes set out in section 5 below. We otherwise have routines for how we store or de-identify personal data to continuously ensure that your personal data always must be adequate and relevant. From where the data is retrieved
4.2. The information is collected directly from you through the information you provide to us when you register as NOBH Independent Partner and the information you later enter or upload on our website. We also processes information about your generated sales that are created with us in connection with customers or other NOBH Independent Partners ordering goods and services from us.
4.3. You must provide the information we request for the partner agreement in order for you to become NOBH Independent Partner. That you provide the information we request is therefore necessary for us to be able to enter into an agreement with you.
5. What personal data we process about you and the reasons for the processing, etc.
We process personal data to administer the partnership and to be able to report points and commissions.
5.1. When you register as a NOBH Independent Partner, you enter into an agreement with us. We will therefore process all the personal data you provide to us in connection with registration or that you later provide to us, such as information about your name, social security number, address, e-mail address and telephone number, and information about how you came into contact with us, such as IP address, to fulfill the agreement with you - i.e. to administer your partner agreement and/or your subscription, deliver ordered goods and services to you, administer payment for them and to manage and fulfill any warranty obligations relating to the goods you purchase. We call these types of personal data provided to us within the framework of the partner agreement or during orders "Partner data" and "Order data".
5.2. The Order data that we collect to administer and otherwise handle your orders will be processed to fulfill the agreement with you during the time that your business relationship with us is ongoing and during the time of any warranty obligations on our part.
5.3. The Partner data we collect will be processed as long as you are a NOBH Independent Partner and thereafter until we have reported all commissions or other benefits you may be entitled to according to the partner agreement, this in order for us to be able to fulfill our agreement with you.
5.4. Your Partner Data will also be processed as long as any other NOBH Independent Partner is entitled to commission or points based on the sales to you and to the customers you recruited and to the customers who otherwise chose to be associated with you as a NOBH Independent Partner. In these cases, the data is processed with the support of a so-called balancing of interests where the legitimate interest does the processing is permitted, NOBH's obligation to fulfill our accounting obligation towards the NOBH Independent Partners concerned. We process personal data when using our website.
5.5. When you use our website, we may automatically collect and process technical information including IP address, login information, type and version of operating system and device, time settings, selected language, cookies, time spent on orders, button presses, etc. We call these types of personal data provided in connection with your use of our website "User data".
5.6. Your User Data is processed to give you authorization to log in and use your user account on our website, to ensure your identity, to have accurate and up-to-date information about you, to enable you to follow and administer ongoing orders, to manage your choices of settings and information about payment, in order to develop and improve our website and the IT systems used to provide it as well as otherwise being able to deliver ordered goods and services to you in accordance with our General Terms and Conditions. Collected User Data about you will be saved for as long as it is Partner data, we process about you.
5.7. We also process your personal data and information about what you ordered and paid to manage your possible membership in the "Profit Share Holder Club" program.

5.8. The personal data that is processed within the framework of the "Profit Share Holder Club" program is processed as long as you choose to be a member of the "Profit Share Holder Club" program in order to fulfill our membership agreement. We process personal data in order to market our goods and services to you.
5.9. Finally, we process your personal data for marketing purposes, in order to be able to market our products to you.
5.10. Even when the data is processed for marketing purposes, it is done with the support of a so-called balancing of interests where we judge that our interest in marketing our products to you is such legitimate interest that makes the processing permissible. Such processing for marketing purposes will take place for no longer than one year after our business relationship with you has ended. Data that we must process according to law.
5.11. In addition, we may process your personal data to fulfill legal obligations, for example accounting obligations, to the extent and for the time provided by law.
6. Consent to certain treatment and the right to be forgotten Consent to the display of your personal data to other partners.
6.1. An important part of being a NOBH Independent Partner is that you should be able to see what partners associated with you in the so-called partner tree have generated for sales and that you should be able to follow your progress towards a higher partner status. Therefore, all NOBH Independent Partners must consent to their name, location, contact details, partner status and sales data such as organizational structure, order data, turnover, commission, customer service commitments being displayed to other NOBH Independent Partners. When you become a NOBH Independent Partner, you must therefore consent to us processing your personal data for this purpose. If you do not agree to this, it is not possible for you to be a NOBH Independent Partner.
6.2. You may also from time to time be offered to give us additional information about you than that stated above via our website, such as for example uploading a picture of you or participating in campaigns etc. All information that you provide to us and that is not also to be used for any of the other purposes stated above will be processed with your consent. Currently, this applies to;
a) images you upload to our website until you withdraw your consent or until your profile with us is deleted, for example because it has been a long time since you last placed an order and
b) in relation to campaigns, until winners have been selected and winnings distributed in the campaign. When participating in campaigns with us, you also agree to your name and picture being published publicly on our website if you are one of the winners in the campaign.
6.3. Regarding the personal data and during the time that our processing of your personal data takes place only because of your consent, you can withdraw your consent at any time by contacting us. If you then withdraw your consent, the personal data that we process only with the support of your consent will be deleted (the right to be forgotten). If the data is also processed for other purposes, the data will instead no longer be processed for the purposes where the processing was based on your consent.
6.4. If you withdraw your consent to your personal data being shown to other NOBH Independent Partners, it will no longer be possible for you to continue being a NOBH Independent Partner. When you withdraw consent, this is therefore considered at the same time as a termination of your partner agreement.
7. How we will handle your data and to whom it may be disclosed
7.1. The personal data we process about you will mainly be processed internally within NOBH and by companies in the same group as us but may in relevant parts be disclosed to the NOBH Independent Partners who will receive commission or points on sales to or through you as well as to companies that help us with the production and distribution of products and services such as letter and parcel suppliers and other suppliers. We also hire subcontractors of e.g. customer service systems who will receive your personal data in the capacity of personal data assistant for us.
7.2. NOBH will not disclose your personal data to other companies for marketing purposes.
8. Where is your personal data stored?
8.1. Your personal data is mainly stored in IT infrastructure provided by one of our personal data processors. The personal data is handled and stored primarily within the Aisa Region with the exception as shown below.
9. Data processed outside the Asia Region
9.1. NOBH hires personal data assistants for managing customer service systems as well as suppliers and distributors outside the Asia Region. Your personal data will therefore be transferred to the EU/ESS in connection with this processing.
10. Your right to access the data we process
10.1. You have the right to receive information about and a copy of the data we process about you free of charge by contacting us. However, for any additional copies, in addition to the one you are entitled to receive free of charge, we will charge an administrative fee equal to the costs we incur in obtaining and providing the additional copies to you.
11. Your right to rectification and erasure
11.1. If you believe that any information about you is incorrect, you have the right to request that the information be corrected or deleted. In that case, contact us and tell us which information you think is incorrect and tell us why it should be corrected or deleted.
12. Your right to object to certain processing
12.1. You have the right to object to the part of our processing of your personal data that takes place with the support of a so-called balancing of interests. More information about which treatment this applies to can be found in points 5.4 and 5.10 above.
12.2. You can object at any time to the processing that takes place for marketing purposes. If you do so, your personal data will no longer be processed for marketing purposes. If you make another objection; we will test it against the reasons we have for continuing to process your personal data.
12.3. Contact us if you want to object to any part of the processing that takes place with the support of a balance of interests
13. Your right to limitation
13.1. You can also request that the processing of your personal data be restricted (frozen) if you believe that the personal data, we process is not correct, if the processing would be illegal, if we no longer need to save or process the data but if you nevertheless need it to be able to assert legal claims or if you have objected to the processing and until we have handled your objection.
14. Your right to data portability
14.1. You have the right to receive the personal data about you that you have provided to us in a structured, commonly used and machine-readable format in order for you to be able to transfer this data to another personal data controller. This only applies to the information that you yourself have provided to us and only when the processing takes place with the support of your consent or in order for us to be able to fulfill an agreement with you. If you want to obtain your personal data in this way, we ask you to contact us.
15. Your right to lodge a complaint
15.1. At NOBH, we take your privacy seriously. We are therefore very keen that your personal data must always be processed correctly and securely. If you have any comments on our handling of personal data, please contact us.
15.2. If you believe that our processing of personal data is incorrect, you have the right to submit a complaint to the Swedish Data Protection Authority (Data inspection), which is the supervisory authority.
